Consultation for the Draft Private Tree Preservation By-Law has concluded. Thank you to those who participated.

Public Consultation

The Municipality of Kincardine is consulting with Kincardine landowners, residents, environmental advocacy groups, land developers, conservation authorities, and businesses to get feedback on preferences regarding the preferred approach to regulating private tree removal. This will be done through two public engagement platforms/formats:

  • Phase 2: Survey; and
  • A Public Information Session to be held on Tuesday, September 13th at 6:00pm via Zoom

Public feedback from this community engagement process will be provided in the final Staff Report to Council in the fall to receive direction for the next steps with the consideration of the Private Tree By-law.

Background

At the March 14, 2022 Meeting, Kincardine Council received report Environmental Services- 2022-01. From the information brought forward from staff within this report, Council directed staff to investigate opportunities to strengthen private tree protection and bring back a policy for consideration. This resulted in the Draft Tree Preservation By-law.

Under Section 135 of the Municipal Act, 2001, Municipalities are granted specific authority to regulate tree and forest preservation. To further grant Municipalities the power of regulating trees and forest preservation, Bill 85 (Section 270) requires that: A Municipality shall adopt and maintain policies with respect to the way the Municipality will protect and enhance the tree canopy and natural vegetation in the Municipality.

Currently, the only tree related policies that the Municipality has in place are related to public lands only:
